The Andrew Jackson s War On Against The U.s. Bank

The Purpose of this essay is to discuss the Andrew Jackson Administration. I will first talk about Jackson’s war on against the U.S. Bank. Second, I will talk about the Presidential election of 1824, 1828, and 1832. Third, I will talk about the Indian Removal Act as well as the Trail of Tears. Fourth, the ways in which Jackson expanded the power of the president. Fifth and final, the Nullification Crisis of 1832. The Bank of the United States was technically the second bank of the U.S. since the first bank’s charter ended in 1811. The second bank held a monopoly over federal deposits, provided credit to growing enterprises, issued banknotes that served as a dependable medium of exchange, and used a restraining effect on the less well-managed state banks. Jackson didn’t trust the bank and thought it had too much power, so Jackson sought out to destroy it. There were two different groups when it came to opposition, â€Å"soft-money† and â€Å"hard-moneyâ₠¬ . Soft money supporters were progressive, they believed in economic growth and bank speculation. They supported the use of paper money and were mainly made up of bankers and allies to bankers. Hard money supporters were against expansion and bank speculation. They supported coinage only and rejected all banks that used paper money, which included the federal bank. Jackson was a hard money supporter although, he felt sympathy to the soft money supporters. Jackson could not legally end the bank before its charter expired. Is Integrity Ethical And Ethical Standards - 986 Words

Integrity is the personal choice to be honest and hold oneself to moral and ethical standards. People of high integrity exhibit social conscious and compel themslelves to be truthful in their personal and professional responsibilities (Killinger, 2014). Integrity is a valued characteristic in nearly every society. People who act with integrity are well liked, and enjoy positive outcomes through having strong relationships with others. (Peterson, 2004) These relationships are successful because of their ability to create cooperative alliances, and receive social support (Hodgins, 1996). Wowra conducted researching surveying how reports of academic cheating may relate to students moral identities and their sensitivity to social evaluation. In his study university students participated in surveys that evaluated this. The researchers found symptoms of social anxiety were positively correlated with recall of academic cheating. Also, students who placed more importance on their moral identities recalled significantly fewer instances of cheating compared to students who had lower importance on their moral identity. The findings suggest that students are less likely to cheat in school when they place greater emphasis on their moral identity and ar e less sensitive to social evaluation (Wowra, 2007). Students may try to rationalize academic dishonesty through various methods. In one study, the researcher explored the reasons given by college students for cheating during scholastic examinations. In the study, most of the participants defined cheating as taking reminder notes into an examination, getting help during the exam, or theft of knowledge. The students believed the likelihood of cheating was found to be high, specifically with preparation of cheating materials before the examination. State of nature an Example by

What does Hobbes think that life is like in the state of nature The phrase state of nature describes a situation in which unenlightened self-interest is the guiding principle of human conduct. In such a state, Hobbes famously declared in chapter 13 of Leviathan, life will be solitary, poor, nasty, brutish and short; and he proposes the State as a balancing force to ensure that the common good is served. Need essay sample on "What does Hobbes think that life is like in the state of nature" topic? We will write a custom essay sample specifically for you Proceed Hobbes view of the solitary nature of humankind underpins the rest of his thinking. According to Hobbes every person has the same desire to survive and every person has some rational capacity: so every human effort is aimed at bettering the lot of the individual, without thought for the good of the community in essence there is no community. In the end, all men are equal, for, as the same chapter of Leviathan declares, yet when all is reckoned together the difference between man and man is not so considerable as that one man can thereupon claim to himself any benefit to which another may not pretend as well as he. Undergraduates Usually Tell EssayLab professionals:Who wants to write paper for me?Essay writer professionals suggest: Find Your Helping Hand!Custom Essay Order Review Write Essays For Money Custom Essay Writing Service College Essay Writing Hobbes objection to living in such a state was not an objection to self-interest, but to unenlightened self-interest. Mansbridge (3) points out that self-interest as a motivator for political life predates Hobbes by a couple of thousand years; and that Hobbes was reacting in part to the situation current in his time, when social dislocation had seriously stressed the fabric of society. Hobbes thinking was formed partly by his studies of ancient thinkers, particularly the work of Thucydides; partly by the disorder of English society in the period leading up to and during the English Civil War; and partly by ideas of an empirical approach to political science drawn from the new scientific thinking of the age. From Thucydides he drew lessons about power; the disorder in society led him to advocate a strong central authority; and from the new scientific approach he tried to marshal evidence drawn from experience that favored his theories. One area that marked Hobbes thinking as very different from that of his contemporaries was his attitude to religious authority. For Hobbes, morality, liberty and justice are the result of social convention. They have no intrinsic value, but are constructs defined by the State. From here it is a very short step to the view that anything the State is able to enforce is legitimate simply because the State can enforce it. To me, there seem to be inconsistencies in some of what Hobbes says. Undermining much of his position is that evidence from anthropology and related sciences, not available to Hobbes, does not seem to support a theory of chaotic disorder in a state of nature. Most primitive societies are reported, for example by Radcliffe-Brown (1952), to have a strong communal sense of order, often based on a hierarchic family structure. It is not at all a case, as Hobbes would have it in Leviathan, of war of every man against every man. It is not clear that a state of nature, in Hobbes sense, has ever existed. Modern psychological understandings suggest to me that it is unsafe to assert, as Hobbes does, that everyone is basically the same and that there is no possibility of altruism, no possibility of a sense of community, nor any possibility of justice unless an authority figure sets up some basically arbitrary system to impose a set of rules on everyone else. Strauss (10) demonstrates that Hobbes views on mans constant reach for power rests on already rational reflection and is for that very reason not natural, i.e. not innate, not in existence prior to all external motivations, to all experience and education. Hobbes considered the new science of his age could be used to construct a rational, empirical understanding of the foundations of political and social order. He believed the authority and power of the State could impose codes of morality, justice and order on humanity, and in doing so could raise humans from a state of murderous competition for resources and power. Not all the evidence he relied on to construct his theories was reliable; and at times his faith in his method obscured flaws in his reasoning. Works Cited Hobbes, Thomas. Leviathan. 1651. Gun Control Essays (703 words) - Gun Politics In The United States

Gun Control Essays (703 words) - Gun Politics In The United States Gun Control Gun Control: What Is It? One of the most hotly debated topics today is gun control. But what exactly is gun control? Is it making it so hard to own that it takes away from the game or leaves someone in fear of not being able to protect themselves? Could it be that it is there to protect the innocent from being gunned down by a lunatic? All these are good questions and that is why the topic is hard to define, both sides have their own feelings on the issue and it is hard to find a happy medium between the two, but one must try. Gun control doesnt have to be taking guns away or making them harder to get as much as controlling them and enforcing the laws that are already in effect. There are many different viewpoints on the issue of gun control. My personal viewpoint is that all citizens have the right to bear arms. If all of the laws were enforced that have passed legislation we would not need new laws making it harder for those that use firearms for sport and protection. The NRA(National Rifle Association) feels the same way. They feel that legislation would infringe on the constitutional rights of law-abiding citizens. They also believe that gun control is not making it harder to get guns by certain measures but by enforcing laws that are already in effect. They also say that only those laws would affect citizens that use their firearms legally because the people that commit crimes would get guns another way. People that are pro-gun control believe that gun control is to put stricter laws into effect making it harder to get a hold of guns. They believe that the age for purchasing a gun should be changed from eighteen to twenty one. Whatever the definition given by the various pro and anti gun controllers might be there are certain laws that help define gun control. In many states there are laws that allow citizens to carry concealed handguns. One of the largest states to enact this law is Texas and many citizens indicated they would carry a concealed hand weapon because they felt it was needed for self-defense (Goldman 121). There are also laws in many states that put a hold on weapons sold to do a background check. In the case of gun shows the waiting period would outlast the show itself. There are also laws being pressed to limit buyers to a limit of one handgun per month. So you have the opinions and you have the laws but the truest definition itself comes from the Bill of Rights, more specifically the second amendment. The hot constitutional question however is whether the Second Amendment protects states or individuals. The second amendment clearly secures a right of the people. As defined in the constitution itself, A well regulated Militia, being necessary to the security of a free State, the right of the people to bear Arms, shall not be infringed. States from New Hampshire to Kentucky all have laws that were passed entitling citizens to their right to carry weapons in times of defense whether for that of the state, country, or for personal protection. So now youve heard all the sides; personal, pro, anti, and legal arguments, there are many ways to see gun control. From stopping or trying to slow down sales to just getting tough and enforcing the laws already in effect gun control is a hot topic. However the best definition to interpret gun control is, enforcing the laws we already have in effect while also considering some new laws to protect us against the crime of America. We need to try to slow handguns down just stop the gun involved crimes by cracking down and enforcing the law. This may not be a happy medium to either side but it is the way that gun control is being defined at this point in time. Letting it be legal to carry a concealed weapon or firearm but also having certain laws for a waiting period and background check so that firearms dont end up in the wrong hands.

Palladio, the Architect Who Inspired a Popular Window

Palladio, the Architect Who Inspired a Popular Window Andrea Palladio (born  November 30, 1508 in Padua, Italy) transformed architecture not only during his lifetime, but his reinterpreted Classical stylings were imitated from the 18th century until today. Today Palladios architecture is a model for building with the 3 rules of architecture attributed to Vitruvius- a building should be well-built, useful, and beautiful to look at. Palladios Four Books of Architecture was widely translated, a work that quickly spread Palladios ideas throughout Europe and into the New World of America. Born Andrea Di Pietro della Gondola, he was later named Palladio after the Greek goddess of wisdom. The new name is said to have been given to him by an early employer, supporter, and mentor, the scholar and grammarian Gian Giorgio Trissino (1478-1550). It is said that Palladio married a carpenters daughter but never bought a house. Andrea Palladio died August 19, 1580 in Vicenza, Italy. Early Years As a teenager, the young Gondola became an apprentice stone cutter, soon joining the guild of masons and becoming an assistant in the workshop of Giacomo da Porlezza in Vicenza.  This apprenticeship proved to be the opportunity that brought his work to the attention of the older and well-connected Gian Giorgio Trissino. As a youthful stone cutter in his 20s,  Andrea Palladio (pronounced and-RAY-ah pal-LAY-deeoh) worked on renovating  Villa Trissino in Cricoli. From 1531 to 1538, the young man from Padua learned the principles of Classical architecture when he worked on new additions for the villa. Trissino took the promising builder to Rome with him in 1545, where Palladio studied the symmetry and proportion of the local Roman architecture. Taking his knowledge back with him to Vicenza, Palladio won a commission to rebuild the  Palazzo della Ragione, a defining project for the 40-year-old budding architect. Important Buildings by Palladio Andrea Palladio is often described as the most influential and most copied architect in Western civilization after the Middle Ages. Drawing inspiration from the architecture of ancient Greece and Rome, Palladio brought decorative columns and pediments to 16th century Europe, creating carefully proportioned buildings that continue to be models for stately homes and government buildings throughout the world of architecture. Palladio window design came about from his first commission- rebuilding the Palazzo della Ragione in Vicenza. Like architects today, Palladio was faced with the task of rejuvenating a crumbling structure. Confronted with the problem of designing a new front to the old regional palace at Vicenza, he solved it by surrounding the old great hall with an arcade in two stories, in which the bays were nearly square and the arches were carried on smaller columns that stood free between the larger engaged columns separating the bays. It was this bay design which gave rise to the term Palladian arch or Palladian motif, and has been used ever since for an arched opening supported on columns and flanked by two narrow square-headed openings of the same height as the columns.- Professor Talbot Hamlin The success of this design not only influenced the elegant Palladian window we use today, but it also established Palladios career during what became known as the High Renaissance. The building itself is now known as theBasilica Palladiana. By the 1540s, Palladio was using classical principles to design a series of country villas and urban palaces for the nobility of Vicenza. One of his most famous is Villa Capra (1571), also known as the Rotunda, which was modeled after the Roman Pantheon (126 A.D.). Palladio also designed Villa Foscari (or La Malcontenta) near Venice. In the 1560s he began work on religious buildings in Venice. The great basilica San Giorgio Maggiore is one of Palladios most elaborate works. 3 Ways Palladio Influenced Western Architecture Palladian Windows: You know youre famous when everyone knows your name. One of the many architectural features inspired by Palladio is the popular Palladian window, readily used and misused in todays upscale suburban neighborhoods. Writing: Using the new technology of movable type, Palladio published a guide to the classical ruins of Rome. In 1570, he published his masterwork: I Quattro Libri dell Architettura, or The Four Books of Architecture. This important book outlined Palladios architectural principles and provided practical advice for builders. Detailed woodcut images of Palladios drawings illustrate the work. Residential Architecture Transformed: American statesman and architect Thomas Jefferson borrowed Palladian ideas from Villa Capra when he designed Monticello (1772), Jeffersons home in Virginia. Palladio brought columns, pediments, and domes to all of our domestic architecture, making our 21st century homes like temples. Author Witold Rybczynski writes: There are lessons here for anyone building a house today: instead of concentrating on increasingly refined details and exotic materials, focus instead on spaciousness. Make things longer, wider, taller, slightly more generous than they have to be. You will be repaid in full.- The Perfect House Palladios architecture has been called timeless. Stand in a room by Palladio- writes  Jonathan Glancey, architecture critic for The Guardian, any formal room will do- and you will experience the feeling, both calming and elevating, of being centred not just in architectural space, but in yourself. This is how architecture should make you feel. Research Design Essay Example | Topics and Well Written Essays - 500 words

Research Design - Essay Example The researcher considers the impact of confounding variables while attempting to establish the effect of the treatments by measuring changes in the dependent variable. Central to this design is random assignment. In a sense, this is the only design that can truly establish to greater degree than other designs the cause-and-effect relationship between and among variables. This is done through statistical methodologies to measure if the changes observed are significant enough to warrant causality. An example of these statistical tools is the ANOVA. The quasi-experiment, as opposed to the true experiment, does not employ random assignment. Instead, the subjects are chosen out of convenience to be part of a particular group. It can be said then that somehow the researcher may be measuring the effects of confounding variables rather than the target variable. Moreover, the reason for including the subjects in a particular group can in itself serve as a confounding variable. However, this design also has a means of comparing groups. It also uses statistical tools to account for a cause-and-effect relationship. The single-case design relies solely on an individual subject or a group of subjects to test and compare the effects of treatments. Central to this design is the baseline measure from which the researcher compares the posttest measurements.

Pathophysiology - Essay Example In such a case Flovent 110 and Severent is prescribed. Flovent is administered in three doses for the low dose 44ug, medium dose 110ug and high dose 220 ug. The Severent is in the form of MDI, which offers 25ug/puff and also in the form of DPI, which gives 50g/blister (p. 555). Flovent is not an immediate cure therefore one should never increase the dose either stop using the drug. I agree that the patient education is necessary because Flovent is administered orally, and one should shake the container before use. The patient is supposed to breathe deeply and then exhale. As the patient is inhaling one is supposed to put the lips around the mouthpiece and push the container. The patient is supposed to rinse the mouth with water and avoid spraying the drug into the eyes (Pocket Books & Thompson, 2007). I agree Stacey Kneeland that controllers assist in managing inflammation and swelling of the airways and prevent them from being delicate to asthma provocative (Graham & ‎Kurtis, 2010). Inhaled corticosteroids are safe and well condoned when used in the right dose. The two commonly used inhalers are budesonide and fluticasone. Moreover, patient education is imperative because they are supposed to rinse their mouths and spit after inhalation when using inhaled corticosteroids. A sitcom is a 30 minutes programme, which contains humour and different types of comedy. In this essay, I will evaluate the extant to which the episodes The Simpsons roasting on an open fire Sitcoms of the past showed the ideal family; always nuclear a mum, dad and kids. The dad was respected and it had a bread winner mum-housewife cooks and cleans with two kids, the son is mostly the clever one and the daughter follows in the footsteps on her mother. E. g. leave it to beaver and the Cosby show. Sitcoms are popular because they relate to real people, take the Simpsons as an example, Homer can relate to people that an unorganised an lazy people; Marge is a representation, responsible, hardworking housewife; in Lisa we can relate to nerdy person and through Bart can relate to people that are not very clever and like skate boarding and rock music. The Simpsons opening scene starts with the title effect which Christmas snow effect with jungle bells and at the start of the scene there are late to a special Christmas concert where they arrive there children will be singing and when they arrive we know that the parents are tired and Homer drives fast and hits the car at this opening scene is called The Simpsons Roasting on an open fire which we know that there will be trouble. It follows the traditional structure of sitcoms. It has an orientation when the family prepare for Christmas and it is going to be expensive which is the beginning of the story; a complication produces problems, which makes the audience laughs when Homer doesnt Evaluate the extent to which The Simpsons follow the conventions of a typical Sitcom The Simpsons are an animated U. S Sitcom family and up to a point are a typical realistic family of five. They have their good and bad times. In this essay, I will be evaluating to what extent The Simpsons follow the conventions of a stereotypical Sitcom. To support this, I am going to be referring in detail to an episode of The Simpsons called The Simpsons Roasting On An Open Fire. A Sitcom is a 30 min comedy T. V show about a family; in a sitcom the main character is usually the father. I will analyse how sitcoms have changed over time, Sitcoms use to only air upper/middle class familys which were white familys only, but as time went past ant the racism cooled down, they started to air black familys as well, in my opinion The Simpsons are made bright yellow is to make a joke out of sitcoms because sitcoms use to be aired as white people only in the past. The opening sequence in the episode starts with the title The Simpsons Roasting On An Open Fire with some jingle bells and Christmas effects. Then it jumps into Homer Marge driving to their childrens concert in dangerous situations. Marges voice makes her sound really tired, but homers voice just makes him sound silly, not the typical father you would find in other Sitcoms. Marge actually believes that Barts ironic humour is right; it shows that they must care for Bart more in my opinion. From analysing The Simpsons Roasting on an open fire I have seen that the orientation is getting ready for Christmas expenses. Evaluate the extent to which The Simpsons follow the conventions of a typical sitcom. Refer to a specific episode that you have watched to support your evaluation. A sitcom is another word for situation comedy for example, Leave It to Beaver which was the first US sitcom in the 1950s. A sitcom is usually about a family consisting of dad, mum and two children. This is called a nuclear family. The situation or setting that the story takes place in is their home. Sitcoms are shown on TV and usually lasts for half an hour. It is a comedy and you can usually hear a live studio audience in the background. In the past, sitcoms always showed happy conventional white families who were always perfect. Dad was always the breadwinner and had a highly respectable job and the mother was always very attractive and happy to stay looking after the home and children. In Leave it to Beaver the son was a high achiever like the father and the daughter wanted to be a homemaker like mum. Sitcoms have changed over time because today mothers may now have careers and dads have to have respect for their wives just as they have respect for themselves. These days family problems are not hidden and people want to see realistic life-like situations in sitcoms. However although sitcoms started to show other families like a black family in The Cosby Show, they were still upper middle class. The Simpsons was the first sitcom to really show problems faced by working class families. Sitcoms are popular because all ages can watch it for fun and enjoyment; charaters of all ages provide someone for everyone to identify with. The Simpsons are even more popular because as an animation they can also have other celebrity characters such a Barry White and Michael Jacson. The Simpsons episode Simpsons Roasting On An Open Fire had an opening sequence where the title came up through snowflakes and jingly music. We hear Marge speaking to Homer saying Oh slow down Homer! which shows she is worried. Homers response, We dont have time to slow down were late makes us think that he is stubborn, wanting things his way and that he doesnt think too much about the safety of his wife and baby. This opening sequence immediately lets us see that this family is not perfect but realistic. We can see from this episode that The Simpsons does follow the traditional narrative structure. The audience gets orientation from not only the opening sequence but also the next couple of scenes where they were at the school Christmas performance, putting up Christmas lights and the children asking for expensive difficult presents. Earnest J. Gaines A Lesson Before Dying Essay -- Gaines Lesson Before

Earnest J. Gaines' A Lesson Before Dying A Lesson Before Dying, by Ernest J. Gaines is set in a plantation community in rural Louisiana. The two main characters in the novel, Grant and Jefferson, are engaged in a struggle to achieve self-respect in society, which allots them none. The story takes place at the end of the 1940s, a time when Louisiana and many other southern states were practicing segregation. The second college edition of the American Heritage Dictionary defines segregation as, â€Å"†¦The policy and practice of imposing the social separation of races, as in schools, housing, and industry†¦Ã¢â‚¬ (1111). Mr. Gaines employs a variety of settings to illustrate how this cruel practice invades every aspect of Grant and Jefferson’s lives; from religion and legal process to love. In the courtroom, the defense lawyer insinuates that Jefferson is less than a man because of his physical characteristics and apparent lack of intelligence. He asks the jury, â€Å"†¦do you see a man sitting here? Look at the shape of this skull, this face as flat as the palm of my hand†¦do you see a modicum of intelligence?† (7). He further degrades Jefferson by referring to him as a thing, â€Å"What you see here is a thing that acts on command†, and finally as an animal, â€Å"†¦I would just as soon put a hog in the electric chair as this.† (7-8). Evidently, discrimination and stereotyping based on the degree of skin pigmentation exhibited existed as a hierarchy with the lightest skin pigmentation on top and the darkest on the bottom, with the each individual cluster discriminating against the one beneath them. Grant’s former schoolmaster, Mathew Antoine, may have been a male role model for him. However, professor Antoine was bitter, he loathed himself ... ...grained the principles of slavery and its progeny (segregation) were in Louisiana society. It is unfathomable that people (i.e., the Creole) exposed to unjust discrimination based simply on their pigmentation, would in turn discriminate against others for similarly unfounded and irrational reasons. From the courtroom to the jailhouse, Grant and Jefferson faced discrimination. However, when they finally realized that the stereotypes being forced upon them were only physical confinements, not mental or spiritual confinements, they were able to identify their own self-worth and achieve self-respect. â€Å"Only when the mind is free has the body a chance to be free.† (251). AMER and NASDAQ Comparison

Question No. 1Both AMEX and NASDAQ are stock exchanges that have evolved from the demands of the times. AMEX or the American Stock Exchange started out as a stock exchange in the streets, or in the curb to be more precise, dealing stocks of companies that are not important enough to be a member of the New York Stock Exchange (NYSE) (Psst, n.d., para. 6 and 7). NASDAQ or National Association of Securities Dealers Automated Quotations System, on the other hand, was born after the advent of the computer age, answering the call of technology-based companies for a stock exchange of their own. Because of this, NASDAQ’s procedures differ from AMEX significantly ((Psst, n.d., para. 8 and 9).Another similarity between the two exchanges is their common competitor, the NYSE. The biggest companies are traded in the NYSE which accounts for its popularity. There are on-going plans to merge AMEX and NASDAQ in the quest of making a stock exchange that is more competitive with the ever popular NYSE (Psst, n.d., para. 12). The two exchanges can compliment each other because of the different ways by which they conduct their business. These differences will be discussed in the later part of this paper.AMEX and NASDAQ each cater to a specific type of company. NASDAQ is preferred by firms like Microsoft, Intel and Apple (Psst, n.d., para. 9). These companies are involved mainly in technology. They are more comfortable with the system used by NASDAQ since it is an exchange that uses computers in its operations. Since AMEX was created as an answer to companies who cannot get into the NYSE, AMEX listings include small and mid-cap companies, companies that are not qualified to join the NYSE. AMEX has an impressive listing of options and exchange traded trusts. AMEX â€Å"specializes in energy companies, start-ups and biotech firms† (Investigator guide staff, n.d., para. 1).Question No. 2The differences between the operations of the two exchanges are many. AMEX operations i s similar to that of a traditional exchange. There is a floor where the buying and selling takes place. Buying and selling are done personally with buyers and sellers gesturing their offer and acceptance. The system is more personal, the buyers and sellers interacting face-to-face. In fact, AMEX started by trading in the curb only to move on to a building of its own with its own â€Å"floor†. NASDAQ uses electronics in its operations. NASDAQ does not have a trading floor where buyers and sellers meet to conduct trade. Buyers use telephones and computer terminals which contains the information on the securities being traded in real time.NASDAQ used to be considered as an â€Å"Over the Counter Exchange†, but as the term evolve over the years, NASDAQ is no longer considered as such. Initially, â€Å"Over the Counter Exchanges† are those which conduct trading without â€Å"trading floors† (Investigator guide staff, n.d., para. 3). Now, the term only refers t o exchanges that trade stocks that do not qualify in any of the major exchanges (Investigator guide staff, n.d., para. 3). Since NASDAQ is considered a major exchange, it is no longer considered an â€Å"Over the Counter Exchange†. As stated above, the companies dealing in technology find the system of NASDAQ more efficient than that of AMEX.The system of NASDAQ, allows for a â€Å"spread† which is kept by the buyer or stock broker as part of his profit. A spread is the difference between the selling price and buying price. Under NASDAQ’s system, dealers and brokers are able to sell directly to the buyers through computers and are not required to disclose the amount with which sellers are willing to sell their securities. Dealers and stockbrokers can increase such cost provided there are buyers willing to buy the same, any difference is theirs to keep. Because the system is prone to abuse, the government has enacted regulations to govern trading done through thi s system. (Psst, n.d., para. 13 -16).Because of the difference with which the two exchanges conduct their operations, the companies registered under them are from different industries. As mentioned above, NASDAQ specializes in companies engaged in technology, such as Microsoft and CISCO. On the other hand, AMEX specializes in energy companies and biotech firms.Question No. 3The collapse of Worlcom, Inc. and the conviction of its Chief Executive led to many losses not just in the telecoms industry but also in other industries. The fiasco that was Worldcom led to the revival and enactment of the Sarbanes-Oxley Act of 2002 (Belson 2005).. This piece of legislation provided for very specific accounting and auditing guidelines and detailed corporate disclosure. While this legislations aims to protect investors from the creative and dubious accounting practices of some corporations, corporations find the law stifling (Belson 2005).Worldcom continued to exist after the fiasco, reverting to its former name MCI. While it used to be a huge corporation that gobbles up smaller telecoms on its path to dominance, it struggled to survive in a much diminished state. The bankruptcy of the company meant that many people lost their jobs, savings and retirement benefits. Many of those who had worked for the company for a long time found themselves starting over again.During its heyday, Worldcom tactics has forced AT&T and other telecom companies to drastically lower the costs of their services to be competitive (Belson 2005). AT&T needed to cut cost by reducing its work force. These events and several ill-timed investments led to the decline of the once mighty AT&T, a decline from which it never fully recovered.ReferenceBelson, K. January 18, 2005. Coca-Cola vs Pepsi Essay

wo of the largest and most profitable corporations in the United States are the Atlanta, Georgia based Coca-Cola Company and the New York based Pepsi Cola Company. While both are called â€Å"colas† they both attempt to address the same target tastes but from different approaches. Coke was the first on market with what is still a â€Å"secret† formula and Pepsi followed with a similar (not exact) taste. Since taste is very much a factor of your personal likes, either or neither may appeal to you or seem sweeter (Inforefuge.com. 2011). This paper will discuss the similarities and differences in the processes used by Coca-Cola and PepsiCo for place, price, and promotion. Place and Price The marketing exposure of PepsiCo and Coca-Cola is everywhere ranging from commercials, billboards, and mail advertisements all over the world. Although they target the same markets, they both use different approaches to their marketing strategies. This is evident when comparing the two companies’ websites. When browsing the Coca-Cola website you will experience a more conservative style; there is not a variety of colors besides the traditional â€Å"Coca-Cola red† in which, most their products are packaged and advertised. It is the complete opposite for PepsiCo, as their website flashes promotions for free music downloads and reminds browsers that they are the official drink sponsor of the NFL. After browsing the websites and comparing the two, you will come to understand that Coca-Cola has more of an International approach to marketing, whereas PepsiCo caters to more of the American†¦ coca The Coca Cola corporation is a beverage company and is defined to be the most well known trade mark in the world, and it is justly so. The Company owns or licenses and markets more than 500 nonalcoholic beverage brands, primarily sparkling beverages, but also a variety of still beverages, such as waters, enhanced waters, juices and juice drinks, ready-to-drink teas and coffees, and energy and sports drinks. It owns and markets a range of nonalcoholic sparkling beverage brands, which includes Coca-Cola, Diet Coke, Fanta and Sprite. The Coca Cola products appeal to a wide range of people throughout the world from all races, genders, and ages. Coca Cola is well  known for its worldwide popularity as its products are sold to over 200 countries. The company business units include Eurasia and Africa, Europe, Latin America, North America, Pacific, Central Japan, and Great Plains and Honest Tea, Inc., in the United States . Coca-Cola and Pepsi are the two most popular and widely recognized beverage brands in the world. They have been competing in the soft drink sector for over a century and both companies enjoy a high degree of brand consciousness globally. Both companies try to market as part of a lifestyle. Coca-Cola uses phrases such as â€Å"Coke side of life† in their website, while Pepsi uses phrases such as â€Å"Hot stuff† in their web, to promote the idea that Pepsi is â€Å"in sync† with the cool side of life. Ironically, both Pepsi and Coke have similar beginnings: both were created in the 19th century and both were the results of the experimental work of innovative pharmacists. Coke was created in 1886 by Atlanta pharmacist John Pemberton while Pepsi was developed in 1898 by North Carolina pharmacist and drugstore owner, Caleb Bradham. The primary purpose of this report is to identify and analyze the two dominant companies in the soft drink industry and determine the strongest performer as an investment opportunity. Ability to pay current liabilities The current ratio is mainly used to give an idea of the company’s ability to pay back its short-term liabilities (debt and payables) with its short-term assets (cash, inventory, receivables). The higher the current ratio, the more capable the company is of paying its obligations. A ratio under 1 suggests that the company would be unable to pay off its obligations if they came due at that point. While this shows the company is not in good financial health, it does not necessarily mean that it will go bankrupt, as there are many ways to access financing, but it is definitely not a good sign. Based on the financial statements below, Coca Cola has a current ratio of 1.17 while Pepsi is at 1.10. The current ratio can give a sense of the efficiency of a company’s operating cycle or its ability to turn its product into cash. Comparison of Pepsi and Coca Cola Financials Introduction Coca-Cola and Pepsi are the two most popular and widely recognized beverage brands in the world. Coca-Cola uses phrases such as â€Å"Coke side of life† in their website, while Pepsi uses phrases such as â€Å"Hot stuff† in their web, to promote the idea that Pepsi is â€Å"in sync† with the cool side of life. The current ratio can give a sense of the efficiency of a company’s operating cycle or its ability to turn its product into cash. In this particular case, Companies that have trouble getting paid on their receivables or have long inventory turnover can run into liquidity  problems because they are unable to alleviate their obligations. Because business operations differ in each industry, it is always more useful to compare companies within the same industry. This is another side of the rivalry between these corporations. Profits over the past three years The Return on Assets (ROA) is an indicator of how profitable a company is relative to its total assets. ROA gives an idea as to how efficient management is at using its assets to generate earnings. Calculated by dividing a company’s annual earnings by its total assets, ROA is displayed as a percentage. Sometimes this is referred to as â€Å"return on investment†. The formula for return on assets is: ROA = Net income / Total Assets. The Return on Equity is the amount of net income returned as a percentage of shareholders equity. Return on equity measures a corporation’s profitability by revealing how much profit a company generates with the money shareholders have invested. ROE is expressed as a percentage and calculated as: Return on Equity = Net Income/Shareholder’s Equity. (Investopedia.com) Based on their financial statements, Coca Cola got a return on assets of 16.19%. Over the same period, PepsiCo return of assets was 9.27%. The return on equity for Coca Cola was 38.09% while Pepsi’s was 29.86%. All these numbers suggest that Coca Cola is giving a better performance than Pepsi in 2010. Pepsi is not delivering as much value to stockholders as Coca Cola. Cash Flow and Investment valuation ratio Pepsi and Coke both offer similar dividend yields of 3%. Although Pepsi’s dividend payout ratio is slightly lower than Coca Cola’s, the difference is marginal. (Finance) The Dividend Payout Ratio means the percentage of earnings paid to shareholders in dividends. The payout ratio provides an idea of how well earnings support the dividend payments. More mature companies tend to have a higher payout ratio. This ratio is calculated as Dividends per share / Earnings per share. The Dividend payout ratio for Coca Cola is 48.2% while PepsiCo is 34.8% The price/earnings ratio (P/E) is the best known of the investment valuation indicators. It is the measure of the share price relative to the annual net income earned by the firm per share. The P/E ratio has its imperfections, but it is nevertheless the most widely reported and used valuation by investment professionals and the investing  public. The financial reporting of both companies and investment research services use a basic earnings per share (EPS) figure divided into the current stock price to calculate the P/E multiple (i.e. how many times a stock is trading (its price) per each dollar of EPS). A high PE ratio generally indicates increased demand because investors anticipate earnings growth in the future. The PE ratio has units of years, which can be interpreted as the number of years of earnings to pay back purchase price. The price/earnings ratio for Coca Cola is 12.97 while PepsiCo is 16.24. (YCharts, 2011) Decision about which company is better for an investment Possibly one of the biggest rivals in Corporate America today, the battle between Coca-Cola (KO) and PepsiCo (PEP) continues to baffle not only consumers but investors as well in determining which product is a better buy. While both companies have had recent problems in emerging nations such as India by having their products be condemned for improper ingredients, a shakeup like this might be necessary to promote future growth for possibly undersold equities. While both Pepsi and Coke stand to benefit from a recovery in consumer spending, it appears that Pepsi has stronger fundamentals. For investors looking for safe dividend stocks with strong growth potential, Pepsi looks like the better choice. In terms of fundamentals, Pepsi seems to have the slight advantage. While Coca-Cola does have the higher figures, Pepsi has the better margins in terms of operating margins, revenue, and profit which is more important for growing companies. Pepsi also has, according to Yahoo Finance, been upgraded more times than Coca-Cola during the last few months, signaling a favorable sentiment among investment banks. In terms of guidance, both companies look to secure better procedures in the emerging markets with their products which should hurt earnings for a while but eventually boost them due to economies of scale. However, recently Pepsi has had positive surprise EPS statements during its quarterly results. While Coca-Cola has also reported similar reports, the findings were at a much smaller margin, barely affecting shares. What is more important, in determining a choice between these equities, is the technical analysis involved. During the past year Coca-Cola has only remain in a five dollar range, showing little fluctuation patterns for speculators or investors. While such a figure may be encouraging for fixed income  advocates, in reality, since 2000, Coca-Cola has barely fluctuated at all in its 20 point range, showing no signs of potential growth. While the situation is unfortunate, it looks as if, like Microsoft, Coca-Cola has increased in terms of value to its maximum, and pretty soon diseconomies of scale may be evident for this once prosperous company causing shares to drop in the future. On the other hand, Pepsi has seen continued growth throughout its tenure in a nice steady growth pattern. While speculators may not be encourage by the slow appreciation of the stock, long term investors may favor such a pattern as it does not seem the price of Pepsi has peaked. The company is still in the prime of its career and should carry the stock to higher numbers in both fundamentals and shares for at least one more decade. By investing now, investors have the opportunity to see Pepsi rise to near 80-100 points by 2010 and possibly even further by 2015. While the wait may be more tedious than other penny-stocks, the process will be relativity stress free as investors will be allowed to see their capital gains appreciate over the years. Such as a process is also favorable with its dividend payoff which allows for reinvestments to increase gains. Non-Financial criteria to consider About Pepsi, recently has appointed a CEO with an Indian background who may look more favorable than Coca-Cola to the emerging markets. Such a basic presence may add increased pressure to Coca-Cola to spend more money on advertisements and other apparels to strike a similar chord in these markets as its soft drink counterpart. While it is genuinely assumed that Coca-Cola is the king of its industry, times are slowly changing for the worse for this tremendous corporation and looking more and more favorable its hated rival in PepsiCo. According to stock analysts, Pepsi has a lot more exposure to commodities with respect to its Frito-Lays and Quaker Oats, when commodity prices were falling; it gave more wiggle room on the bottom line. But now that commodity prices are probably going to increase in the next year to year and a half, which opens up the door for Coke to expand their lead. Coke always held the bigger market share in the United States. But at times, Pepsi fueled by smarter and more aggressive advertising campaigns, moved ahead. U.S. Consumption of carbonated soft drinks has steadily declined in the past decade. Part of that comes down to the array of  alternative beverages the market now offers.

Population vs Populace

Population vs Populace Population vs Populace Population vs Populace By Maeve Maddox Lately I have begun to notice speakers and writers using the word populace where I would expect to see the word population. For example: With a young and skilled workforce – 65% of Turkey’s 74 million populace is under the age of 34 – producing 500,000 graduates a year, Turkey is now classified as a fast developing economy. Meanwhile, 3.7 percent of the 2012 populace – or roughly 23,436 people – held doctorates. Both words, population and populace, derive ultimately from a Latin word for people, but the words entered English with distinctive meanings. From the beginning, population referred to the collective inhabitants of a place, whereas populace had the meaning â€Å"ordinary people† as opposed to the titled, wealthy, or privileged classes. In Frances Hodgson Burnett’s The Little Princess (1905), the protagonist has been taught by her middleclass father to be kind to â€Å"the populace.† Thrust suddenly from a comfortable life into poverty, Sara learns what it is to be hungry. On the way to buy some buns, she notices a ragged little girl with â€Å"hungry eyes†: Sara knew they were hungry eyes the moment she saw them, and she felt a sudden sympathy. â€Å"This,† she said to herself, with a little sigh, â€Å"is one of the populace- and she is hungrier than I am.† Not only did the word populace refer to the less privileged part of the population, it was also used as a pejorative term for â€Å"the mob, the rabble, the unthinking masses.† Populace is increasingly used as a mere synonym for population, but its other connotations linger: The upper-middle class wants to lead an aroused populace against the true enemy, but the populace isn’t listening.- The American Interest, Vol. 6, No. 3, January 11, 2011. Population  is neutral, while  populace  often carries a superior tone toward the group it refers to.- The Grammarist The connotation of ignorance, fickleness, and tractability is present in the following quotations: A Scare A Week Keeps the Populace Meek The direction of the government is driven by raw emotion; it can change from one day to the next, depending on how effectively demagogues are able to harness and control the populace. An uninformed populace will fall for anything. The term argumentum ad populum, â€Å"appeal to the populace† is applied to the logical fallacy also known as â€Å"appeal to the masses† and â€Å"the bandwagon fallacy.† The verb sway is frequently found in tandem with populace: Choice of political candidates solely by popular referendum is one of the greatest dangers to a democracy as it opens the way for demagogues and liars to sway the populace with empty rhetoric and promises. In elections, the candidates make daily public appearances to sway the general populace. sway transitive verb: To cause to move backward and forward or from side to side. Populace may be taking on a new meaning when used with a modifier: â€Å"a portion of the general population perceived as having shared interests or characteristics.† Here are some examples in which populace is used to denote a segment of a larger population: Hernandez wants to assist Birmingham’s Hispanic populace. North Carolinas immigrant populace emphasizes the financial power of non-native residents via their vital contributions to the states economy. In our community, there are perspectives that continue to compromise and even endanger the lives of our most physically and/or cognitively disabled populace. Population remains the less ambiguous choice when referring to all the inhabitants of a place and not to a specified portion of them. Note: The adjective populous (â€Å"densely populated†) is often used erroneously for the noun populace: INCORRECT: The immigrant populous of the colonial era prompted, at least in part, Jean de Crevecoeurs concept of a new man that differed from European stock in both style and substance.- Egg Harbor Regional High School District, Atlantic County, New Jersey. CORRECT :   The immigrant populace of the colonial era prompted, at least in part, Jean de Crevecoeurs concept of a new man that differed from European stock in both style and substance. Business Law Essay Example | Topics and Well Written Essays - 2250 words

Business Law - Essay Example This is selected because it contains very relevant explanations and outlines of how directors and shareholders are expected to relate towards the collective success of their companies. Several UK case laws are also going to be analysed in such a way that by the end of the discussions, Mary and Joseph would clearly identify areas of legal liability in the conduct of their directors and areas where no legal liabilities exist. Directors’ Duty Duty owed to the company and not individual shareholders First, it is important for Mary and Joseph to realise that prior to CA 2006, the directors owe their duty to the company as a body and not to individual shareholders of the company. However, it has been explained earlier that the company is only an artificial person, who must be represented by natural people. Mary and Joseph could therefore direct their actions in such ways that they are either seen as individual shareholders fighting for their interest in the company or as members of the company as a body1. ... Similarly, in Percival v Wright (1902), it was held that the director of the directors in some instances owe fiduciary duties to individual shareholders of the company. By further implication, how a petitioner positions him or herself in cases against the adjudication of the duties of directos is very important in determining what the outcome of the petition would be3. Mary and Joseph will therefore be advised to position their selves as constitute members of the company rather than as interested parties in the acquisition because of the directors’ duty is owed to the company and not to individual shareholders4. Power to issue shares Further advice given to Mary and Joseph would bother on the power that the directors of the company have to issue shares. It would be noted that s 171 CA 2006, which touches on the duty of directors to act within powers clearly outlines the powers given to the directors to exercise powers for the purposes for which they are conferred5. As part of the powers, given by most companies to their directors also, there is the power for the issuance of shares where directors have the right to issue shares that they deem as acts profitable ventures for the company6. In effect, the argument of Mary and Joseph cannot be against the mere issuance of shares in the acquisition process of the subsidiary firm. The acquisition of the subsidiary company through the issuance of shares could easily be justified by the directors through their power to issue shares if the purpose for the formation of the subsidiary company had finished serving its roles7. In Hogg v Cramphorn Ltd (1967), it was held that the directors of the company could not be charged for
